Terms of Service
Effective 13 October 2026
These terms are an agreement between you and InCodeWeSpeak®, a sole proprietorship based in California, United States ("we", "us"), which operates ViewScale. By creating an account, joining a computer to a Space, or otherwise using ViewScale, you agree to them. If you use ViewScale for an organisation, you agree to them on its behalf and confirm you may. Our Privacy Policy describes how we handle information.
Section 15 asks you to settle disputes with us by individual arbitration, not in court or as part of a class action, unless you opt out as it describes.
1. The service
ViewScale lets people and AI agents reach computers remotely: to see and control the screen, hear its sound, chat with whoever is at it, move files and run commands, as each Space's roles and Policies allow. A computer takes part by running the ViewScale Machine, either as a temporary session that ends when its window closes, or installed as a service.
2. Using ViewScale at your own risk
- ViewScale is still changing. It may have bugs, be unavailable, change or remove features, lose data, or end, with or without notice. There is no promise of uptime, support or response times unless we agree one with you in writing.
- Do not rely on it where a failure could cause death, injury, environmental or property damage, or serious financial loss, such as medical, emergency, safety, industrial-control or critical-infrastructure systems.
- You use it at your own risk. Keep your own backups of anything that matters on the computers you connect.
3. Accounts and Spaces
- Give accurate information, keep your sign-in methods secure, and tell us at once if your account is misused.
- You are responsible for everything done through your account, your API keys and the agents you connect.
- A Space's owner decides who belongs to it, their roles, its Policies and its plan, and is responsible for the people and agents they let in.
- You must be at least 16 years old.
4. Acceptable use
You may connect only to computers you own or are authorised to access, and only for purposes their owner and users have agreed to. You must not:
- access, watch, record or control a computer, or a person using one, without the permission the law requires — including consent to recording sound or screens where the law asks for it;
- use ViewScale for anything unlawful, to spread malware, to send spam, to impersonate anyone, or to harm anyone, including in fake "tech support" schemes;
- disrupt, overload or probe ViewScale's servers, get around its limits, encryption or Policies, or reach data that is not yours;
- resell or provide ViewScale to others as a service without our written agreement.
A temporary session asks the person at the computer before it starts. Do not trick anyone into allowing it.
5. Your computers and security
- You decide which computers to connect, who and which agents may reach them, and what their Policies allow. Commands, file changes and other actions taken through ViewScale are taken by you, your Space's members or your agents, not by us.
- We work to keep ViewScale secure, and a person's session contents are encrypted end to end. No system is completely secure, and we cannot promise that unauthorised access, data loss or interception will never happen.
- Keep the computers you connect, and the devices you connect from, updated and protected.
- Tell us about security problems at support@view-scale.com rather than testing them on systems that are not yours.
6. AI agents
Agents you connect act with the access you and your Space's Policies give them. Their actions are your responsibility: review what they may do, and check their work. AI agents can make mistakes.
7. Your content and feedback
What you and your computers send through ViewScale stays yours. You give us only the permission needed to carry, store and process it to provide the service. Session contents are encrypted end to end and we cannot read them. If you send us suggestions or feedback, we may use them without owing you anything.
8. Plans and payment
- The Free plan has the limits shown in the app. Paid plans are sold by number of Machines, billed monthly or yearly in advance through Stripe, and renew automatically until cancelled.
- Moving to a larger plan or a different interval takes effect at once, and the difference is charged, prorated, the same day.
- Going to Free takes effect at the end of the period already paid for. Until then the paid plan continues, and you can keep it instead.
- Payments are not refundable, including for unused time, except where the law requires otherwise.
- Prices may change; a change applies from your next renewal after we tell you. Prices exclude taxes, which are added where required.
- If a payment fails, we may limit the Space to what the Free plan allows.
9. The software
We give you a personal, non-exclusive, non-transferable licence to use the ViewScale Machine to use the service. An installed Machine updates itself to each new release we publish. Third-party components are used under their own licences, listed on the About page. Do not copy, modify, or reverse engineer them except as those licences or the law allow. You must follow the export control and sanctions laws that apply to you, and must not use ViewScale from, or for anyone in, a country or on a list those laws prohibit.
10. Changes and availability
We may change, add or remove features. We work to keep ViewScale available but do not promise it will be uninterrupted or free of errors, and we may take it down for maintenance.
11. Ending
You can stop using ViewScale at any time, delete your Spaces, and ask us to delete your account. We may suspend or end access for anyone who breaks these terms or puts others or the service at risk, and will tell you where we can. We may also end the service at any time. Sections 5, 7 and 12 to 18 continue after access ends.
12. Disclaimer
VIEWSCALE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT IT WILL BE SECURE, ERROR-FREE OR UNINTERRUPTED, TO THE FULLEST EXTENT THE LAW ALLOWS.
13. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS, OR FOR DAMAGE TO COMPUTERS OR DATA CAUSED BY ACTIONS TAKEN THROUGH VIEWSCALE, EVEN IF WE WERE TOLD THEY WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO VIEWSCALE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AND 100 US DOLLARS. These limits apply whatever the legal theory and even if a remedy fails of its essential purpose. Some places do not allow some of these limits, so they may not all apply to you.
14. Indemnity
You will defend and compensate us for claims, losses and costs, including reasonable legal fees, arising from your use of ViewScale in breach of these terms or of the law, including connecting to a computer without permission, and from what you, your Space's members or your agents do through it.
15. Disputes and arbitration
- Talk to us first. Before bringing a claim, email support@view-scale.com with what happened and what you want, and give us 30 days to try to resolve it.
- Individual arbitration. Any dispute that is not resolved will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or its Commercial Arbitration Rules if you use ViewScale for an organisation), by a single arbitrator, online or by phone where possible. Either of us may instead bring an individual claim in small-claims court, and either of us may ask a court to stop misuse of intellectual property or of the service.
- No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, consolidated or representative proceeding, and the arbitrator may not combine claims of more than one person. You and we give up any right to a jury trial.
- Opting out. You can opt out of arbitration within 30 days of first accepting these terms by emailing support@view-scale.com with your name, account email and a clear statement that you opt out. Disputes then go to the courts in section 16.
- Time limit. A claim must be brought within one year after it arose, or it is barred, to the extent the law allows.
16. Governing law
These terms are governed by the laws of the State of California and of the United States, including the Federal Arbitration Act, without regard to conflict-of-law rules. Anything not subject to arbitration goes to the state and federal courts located in California, and you and we consent to their jurisdiction. Nothing here takes away rights consumer law gives you where you live.
17. Changes to these terms
We may update these terms. We will post the new version here with its date and, for a significant change, tell account holders by email before it applies. Continuing to use ViewScale after that means you accept it.
18. General
- These terms, with the Privacy Policy, are the whole agreement between you and us about ViewScale.
- We may transfer these terms, and our rights and duties under them, to a company we form or own to run ViewScale, or to a successor to the business; you may not transfer yours without our written agreement.
- If part of these terms cannot be enforced, the rest still applies. Not enforcing a part straight away does not waive it.
